1. Our site
The design, text, graphics, and code of blackhills.biz are owned by RCP Inc or its licensors and are protected by U.S. copyright and trademark law. Do not copy, republish, or create derivative works from them without our written permission.
2. Content we create for clients
You own it once you have paid. When all invoices for a given piece of content are paid in full, we assign to you all right, title, and interest in that content — blog posts, articles, and social media copy we wrote for you — including the copyright. The assignment is automatic on payment; no further paperwork is required, and we will sign a confirming document if you ask.
Before payment. Until your invoices are paid, we retain ownership. Publishing or using unpaid content is copyright infringement.
3. What we keep
We retain ownership of everything we use to make the work, including:
- Our prompts, prompt libraries, and AI workflows
- Templates, outlines, style frameworks, and checklists
- Research methods, keyword processes, and reporting formats
- Software, tools, and internal systems
- General knowledge, skills, and techniques
Nothing in Section 2 transfers these. If any of them is embedded in a deliverable, you get a perpetual, non-exclusive, royalty-free license to use it as part of that deliverable — but not to extract, license, or resell it on its own.
4. Portfolio use
We keep a non-exclusive right to display content we created for you, and to identify you as a client, as samples of our work in our portfolio, website, case studies, and marketing. Tell us in writing if you do not want this, and we will stop.
5. Material you give us
You keep ownership of logos, photos, text, and other material you supply. You grant us a license to use it as needed to create and publish your content. You represent that you have the rights to it — including rights to any stock images or third-party photos you send us.
6. AI-assisted content
We use AI tools to help produce content. Under current U.S. law, purely AI-generated material may not qualify for copyright protection; protection generally attaches to human-authored contributions and to human selection and arrangement. Our assignment in Section 2 transfers whatever rights exist in the work. We do not warrant that every element of a deliverable is copyrightable or that it is free of similarity to other published material.
7. Reporting infringement (DMCA)
If you believe material on blackhills.biz infringes your copyright, send a written notice to our designated agent including:
- Your physical or electronic signature
- Identification of the copyrighted work claimed to be infringed
- Identification of the material you claim is infringing, with enough detail to locate it (a URL)
- Your address, phone number, and email
- A statement that you believe in good faith the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf

We will investigate and remove or disable infringing material as required by 17 U.S.C. § 512. We may terminate the accounts of repeat infringers. Knowingly making a material misrepresentation in a notice can carry liability under § 512(f).
8. Counter-notice
If your material was removed and you believe it was a mistake or misidentification, you may send a counter-notice to the agent above containing your signature, identification of the removed material and where it appeared, a statement under penalty of perjury that you believe in good faith it was removed by mistake or misidentification, and your name, address, phone number, and consent to the jurisdiction of the federal court for your district (or, if outside the U.S., the District of South Dakota).
